TrueSelf Recovery, along with its affiliates and subsidiaries (collectively referred to as “TS,” “we,” or “us”), operates the website located at trueselfrecovery.com, as well as associated websites, mobile applications, software, networks, and other services linked to these Terms of Use (referred to collectively as our “Sites”). Please note that these Terms of Use do not govern the treatment services or other offerings provided by TS treatment centers. By accessing or using any part of the Sites, or by clicking to accept or agree to these Terms of Use when prompted, you confirm that you have read, understood, and agree to be bound by these Terms of Use and the TS Privacy Policy (together referred to as the “Terms”).

These Terms stipulate that any disputes between you and TS will be resolved through BINDING ARBITRATION. YOU AGREE TO WAIVE YOUR RIGHT TO PURSUE LEGAL ACTION IN COURT TO ASSERT OR DEFEND YOUR RIGHTS UNDER THIS AGREEMENT (except for matters eligible for small claims court). Your rights will be determined by a NEUTRAL ARBITRATOR, NOT A JUDGE OR JURY, and you may not bring claims as part of a class action. For more details, please review the section below titled Dispute Resolution and Arbitration.

You also agree that TS may (1) contact you regarding TS’s services and treatment centers, and (2) monitor and record any phone calls, text messages, or web chats conducted with TS for business purposes, including quality assurance. No mobile information will be shared with third parties/affiliates for marketing/promotional purposes. For additional information, refer to Section 18 below, titled Consent to Communications and Monitoring/Recording of Calls, Texts, and Chats.

1. The Site Does Not Provide Medical or Treatment Advice

THE CONTENT ON THE SITES IS INTENDED FOR INFORMATIONAL PURPOSES ONLY AND IS NOT A SUBSTITUTE FOR PROFESSIONAL MEDICAL ADVICE, DIAGNOSIS, OR TREATMENT. Our mission is to empower individuals, their families, and the broader community by promoting holistic wellness of the mind, body, and spirit. The Sites serve as an extension of this mission, offering a platform for individuals to connect with TS and learn more about our treatment programs. Certain sections of our Sites provide valuable resources for those evaluating or seeking treatment, and TS utilizes a network of affiliated websites to offer multiple avenues for individuals to reach out and explore treatment options.

3. Eligibility

To use our Sites, you must be at least thirteen (13) years old. By agreeing to these Terms, you confirm that you meet this age requirement. If you are accessing the Sites on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms and agree to be bound by these Terms on its behalf.

4. Account Registration

Certain features of our Sites may require you to create an account. During registration, you may be asked to provide personal information, such as your email address or other contact details. You agree to provide accurate information and to keep it updated. When registering, you will create a password, and you are solely responsible for maintaining the confidentiality of your account and password. 5.1 General Guidelines

You acknowledge that User Content may be inaccurate, offensive, or objectionable, and you waive any legal claims against TS related to such content. If TS receives notice that User Content violates these Terms, we may investigate and remove the content without prior notice.

TO THE FULLEST EXTENT PERMITTED BY LAW, TS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES ARISING FROM YOUR USE OF THE SITES. OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS WILL NOT EXCEED THE AMOUNT YOU PAID TO ACCESS THE SITES.

These Terms are governed by the laws of the State of Arkansas. Any disputes will be resolved in the state or federal courts located in Pulaski County, Arkansas.

16. Dispute Resolution and Arbitration

Any disputes between you and TS will be resolved through binding arbitration, except for matters eligible for small claims court. You waive your right to a jury trial or class action.

16.2 Arbitration Process

Arbitration will be conducted by the American Arbitration Association (AAA) under its rules. You must notify TS of any dispute in writing before initiating arbitration.

By providing your contact information, you agree to receive communications from TS, including emails, calls, and texts, for informational and marketing purposes. You may opt out of these communications at any time.
